Educational leave is a legal right that employees have against their employers. This entitlement is determined by the legal framework of the federal state where the employee works, not where they reside. In other words, whether or not you qualify for educational leave depends on the regulations of the state where your workplace is located.
Beyond the location of your workplace, your eligibility for educational leave is also influenced by the length of your employment. In most German states, employees become eligible for educational leave after six months of employment with their company, although some states require at least 12 months of employment.
Additionally, the training you choose during your educational leave—be it cultural, political, or general—should align with and benefit your current career. Since employers must approve applications for paid educational leave, they generally expect the training to provide a positive return on investment

The duration of educational leave varies by state, but generally, employees are entitled to 5 days of educational leave per year. You also have the option to carry over these five days to the following year, allowing you to take up to 10 days of educational leave in the second calendar year.
